By accessing and using unfil's uncensored AI API services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use our Services.

These Terms constitute a legally binding agreement between you ("User" or "you") and unfil ("we," "us," or "our").

Description of Services

unfil provides uncensored artificial intelligence API services, including:

  • Uncensored large language model (LLM) APIs
  • Image generation APIs without content restrictions
  • Audio processing APIs
  • Web search and information retrieval APIs
  • Additional AI-powered tools and services

Important: Our Services are intentionally designed to be uncensored and unrestricted. This means that the AI models may generate content that some users might find offensive, controversial, or inappropriate.

Acceptable Use

Permitted Uses

You may use our Services for lawful purposes, including:

  • Content creation and creative writing
  • Research and educational purposes
  • Business applications and automation

Prohibited Uses

User Responsibility

Uncensored Nature of Services

Explicit Acknowledgment: You acknowledge and understand that:

  • Our AI models are intentionally uncensored and unrestricted
  • The Services may generate content that is offensive, controversial, or inappropriate
  • We do not filter or censor AI model outputs based on content standards
  • You are solely responsible for implementing any content filtering you require
  • Use of uncensored AI models carries inherent risks that you accept

No Warranty on Content

We make no warranties about the appropriateness, accuracy, or reliability of content generated by our AI models. All AI-generated content is provided "as is" without warranty of any kind.

Your Responsibility

You are solely responsible for reviewing, filtering, and appropriately using any content generated through our Services. This includes implementing appropriate age restrictions, content moderation, and user protections when making AI-generated content available to others.

Intellectual Property

Service Ownership

The Services, including all AI models, software, and infrastructure, are owned by unfil and are protected by intellectual property laws.

Generated Content

You own the content generated through our Services, subject to your compliance with these Terms. However, you acknowledge that AI-generated content may not be eligible for copyright protection in some jurisdictions.

Usage Rights

You are granted a non-exclusive, non-transferable, revocable license to use our Services for the duration of your account, subject to compliance with these Terms and any applicable usage limits.

Payment and Billing

Payment Methods

We accept payments through various methods including cryptocurrencies and other payment processors. All payments are final and non-refundable except as required by applicable law.

Usage-Based Billing

Our Services are billed based on usage, including tokens processed, API calls made, and resources consumed. Rates are specified in our pricing documentation and may be updated from time to time.

Billing Disputes

If you believe there is an error in your billing, contact us within 30 days of the charge. We will investigate and resolve legitimate billing disputes in good faith.

Privacy and Data

Your privacy is important to us. Our collection and use of data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Important: We do not store your API prompts or responses after processing, and we do not use your API interactions to train our models. However, AI models may retain context within a single conversation session.

Service Availability and Downtime

Service Level

We strive to provide reliable Services but do not guarantee uninterrupted availability. The Services may be temporarily unavailable for maintenance, updates, or other technical reasons.

No SLA

Unless specified in a separate enterprise agreement, we do not provide service level agreements (SLAs) or uptime guarantees. Use of the Services is at your own risk.

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our Services at any time with or without notice. We are not liable for any losses resulting from such changes.

Disclaimer of Warranties

AS IS SERVICES: Our Services are provided "as is" and "as available" without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that our Services will be error-free, secure, or uninterrupted. AI model outputs may be inaccurate, biased, offensive, or inappropriate.

You acknowledge that you are using uncensored AI services at your own risk and that we are not responsible for any consequences arising from your use of AI-generated content.

Limitation of Liability

MAXIMUM LIABILITY: To the maximum extent permitted by law, our total liability arising from or relating to these Terms or your use of our Services shall not exceed the amount you have paid to us in the three (3) months preceding the claim.

EXCLUDED DAMAGES: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or relating to these Terms or your use of our Services.

This limitation applies even if we have been advised of the possibility of such damages and regardless of the theory of liability.

Indemnification

You agree to indemnify, defend, and hold harmless unfil and our officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or expenses, including reasonable attorneys' fees, arising from:

  • Your use of or access to our Services
  • Your violation of any term of these Terms
  • Your violation of any rights of a third party
  • Content you create, distribute, or make available through our Services
  • Any claims related to the inappropriate or illegal use of AI-generated content

Termination

Termination by You

You may stop using our Services at any time. If you have an account with us, you may close your account by following the account closure process or contacting us.

Termination by Us

We may suspend or terminate your access to our Services at any time, with or without cause, and with or without notice, including for violations of these Terms or applicable laws.

Effect of Termination

Upon termination, your right to use the Services ceases immediately. We may delete your account and data in accordance with our Privacy Policy and applicable laws.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where unfil operates, without regard to its conflict of law principles.

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration institution, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website or providing notice to you.

Your continued use of our Services after any changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using our Services.

Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and unfil regarding the Services.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.
  • Waiver: Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.
  • Assignment: You may not assign or transfer these Terms without our prior written consent.
